‘Cyber-bullying,’ parurusahan ng OSA

BABALA ng Unibersidad: mag-ingat sa inyong mga pahayag sa Facebook, Twitter, at iba pang social networking sites.

Idinagdag na ng Office for Student Affairs (OSA) sa Code of Conduct and Discipline ng student handbook ngayong akademikong taon ang “cyber-bullying” o anumang uri ng misbehavior sa social networking sites.

“Because of the increasing number of incidents concerning students being bullied in social networking sites, we decided that is about time that we emphasize to students that their expression in social networking sites can have repercussion in the University,” ani Antonio Chua, legal consultant ng OSA.

Nakasaad sa naturang probisyon na sa paggamit ng electronic media: “[Students] should avoid doing acts of indecency through the use of indecent words, uploading indecent pictures or images reflecting unchristian behavior of himself or of any persons.”

Dagdag ni Chua, sinuman na mapatutunayang nagpahayag ng masama laban sa kapuwa niya mag-aaral, guro, kasapi ng pamunuan, o sinumang may kaugnayan sa Unibersidad ay bibigyan ng karampatang parusa batay sa kabigatan ng pagkakasala.

Gayunman, kinakailangang magsampa ang isang tao ng reklamo na siya ay nakaranas ng cyber-bullying sa social networking sites bago umaksyon ang Unibersidad.

“The complainant will be the one to present evidence that a person committed the act [of misbehavior] before the latter could be held liable,” ani Chua.

Ang reklamo ay idudulog sa Student Welfare and Development Board ng kolehiyo o facultad ng mga sangkot na mag-aaral, at sa OSA naman kung ang mga sangkot ay nabibilang sa magkaibang kolehiyo. Diringgin lamang ang hinaing kung sapat ang mga ebidensyang inilahad sa isinumiteng written complaint, ayon kay Chua.

Nilinaw ni Chua na ang nasabing probisyon ay hindi nakalalabag sa freedom of expression.

“Freedom of expression is always subject to limitation,” aniya. “If you’re injuring somebody’s reputation, that is the limitation.”

“We are not censoring. We are just making you liable if you injure somebody,” ani Chua.

Ayon kay Journalism junior Arian Vina Sarmiento, magsisilbing paalala sa mga mag-aaral ang nasabing probisyon upang maging responsable ang mga ito sa pagpapaskil sa social networking sites.

“Magsisilbi itong paalala na bilang Tomasino, kailangan natin maging responsable sa paggamit ng social media at siguraduhin na hindi natin masisira ang integridad at pangalan ng ating kapuwa,” aniya.

Ngunit ayon kay Ma. Elka Bungay, isang Pharmacy sophomore, `di na dapat sakop ng Unibersidad ang mga gawain ng mga mag-aaral sa social media.

“Ito naman ay hindi ginawa sa loob ng Unibersidad kaya walang habol ang sinumang mabibiktima,” aniya.

Kinontra ito ni Chua. “You are responsible for everything that you say in the electronic media [and] supposed to act in accordance with the rules of discipline within and outside the University,” aniya.

Walang kawala

Kasama rin sa mga idinagdag ng OSA sa handbook ang pagpataw ng parusang suspensiyon o pagtanggal sa posisyon ng mga opisyal ng student council o organization na mapatutunayang lumabag sa mga alituntunin ng Unibersidad.

“Should the students in violation of [any of] the [University’s] rules be an elected or appointed officer of any of the student organizations, local student council, Student Organizations Coordinating Council, Central Student Council (CSC), [and] Central Comelec, the penalty to be imposed may include suspension or removal from office as the case may be,” ayon sa probisyon.

“Before, if you are suspended as a student, and if you are an officer, the rule does not include any penalty as officer,” ani Chua. “One can be removed now from the office because of his violation [of the rules of conduct].”

Sumang-ayon naman sa panukala ang auditor ng CSC na si Giorgia Maxine Parayno, na nagsabing nararapat lamang sa mga student leaders ang nabanggit na alituntunin ng OSA.

“Hindi mo maituturing ang isang student leader na epektibo kung hindi siya mismo nakakasunod sa patakaran ng Unibersidad,” aniya.

Ayon naman kay Romulo Gabriel Kintanar, assistant treasurer ng College of Science Student Council, magsisilbi itong paalala sa mga student leaders na maging maingat sa kanilang kilos at pananalita.

“Student leaders are expected to exemplify good behavior and to be role models to students,” aniya.
