NAGHAIN ng kasong libelo ang mga dating pinuno ng UST Faculty Union (USTFU) laban sa Committee of Peers (CoP), dalawang miyembro ng “Fidelity Group,” at sa isang office staff/bookkeeper ng unyon dahil sa mga “malisyosong” paratang at pagpapasiya sa ulat ng CoP.
Isinumite nina Gil Garcia, dating bise presidente at Raymundo Melegrito, dating internal auditor ang reklamo sa tanggapan ng Manila City Prosecutor’s Office noong Hunyo 18.
Ang CoP, na binuo noong Hulyo 16, 2010 upang siyasatin ang katotohanan sa ilegal na paglabas ng pondo ng USTFU na nagkakahalaga ng P9.5 milyon, ay pinamumunuan ni Rafael Bautista ng College of Education, kasama sina Apolinario Bobadilla (AMV-College of Accountancy), Pablito Baybado, Jr. (Institute of Religion), Jacinta Cruz (Faculty of Pharmacy), at Fortunato Sevilla III (College of Science). Kasama rin sa mga nireklamo ay sina dating Sergeant-at-Arms Celso Nierra, dating direktor Elizabeth Hashim Arenas at Samantha Lei Bernal, dating empleyado ng unyon.
Sina Nierra at Arenas ay parehong kasapi ng Fidelity Group na noon ay kinasuhan din ni Gil Gamilla, dating presidente ng USTFU, dahil sa pagpapalabas ng mga ulat at dokumento na nagpaparatang ng “illegal disbursement” ng pondo ng unyon sa isang property developer noong 2006.
Ayon sa kopya ng complaint-affidavit nina Garcia at Melegrito na nakuha ng Varsitarian: “Apparently, respondents (Bautista, et al.) made the above malicious imputation in their report purposely to discredit and dishonor our reputation, to tarnish our names and advance their political agenda in supporting and validating Atty. Ngo’s Findings-1, even if their conclusions run counter to the evidence on hand, and to substantiate speculations that Mr. Garcia’s departure and Engr. Melegrito’s loss in the ensuing USTFU election was likewise right.”
Ayon kina Garcia at Melegrito, ilan sa mga pagpapasiyang nakapaloob sa ulat ng CoP tungkol sa pagsisiyasat sa nawawalang pondo ng unyon ay naglalaman umano ng “faulty thinking.”
“The CoP report made against me, Mr. Garcia, the following malicious conclusions culled from its findings of facts that were not based on evidence and some were simply faulty thinking,” ayon sa complaint-affidavit nina Garcia at Melegrito. “Concerning Engr. Melegrito, the CoP made conclusions against him that are partly not based on evidence and partly based on faulty and wishful thinking.”
Tumanggi naman na magbigay ng pahayag sina Garcia at Melegrito ukol dito dahil sa sub judice rule na nagsasaad na maaari silang masipi “for contempt for discussing the merits of the case while it is pending.”
Dagdag din ng complaint-affidavit nina Garcia: “The one-two punch of respondents, Arenas and Nierra is for the purpose of supporting the CoP and Atty.[Jose] Ngo’s theory that Mr. Garcia supplied or produced the certificates of placement, which is a blatant lie.”
Itinanggi naman nila Nierra na sinusuportahan nila ang ulat ng CoP at ang hiwalay na ulat ni Ngo.
“Wala naman kaming malice dyan,” aniya. “If it is libel, there was malice and there was a publication so paano naman kami magiging in charge sa publication na ‘yung result ng interview ng CoP is a confidential thing.”
Tumanggi rin magbigay ng pahayag ang pinuno ng CoP na si Bautista upang maiwasan ang legal complications, samantalng sinusubukan pang kunin ng Varsitarian ang pahayag nila Bernal.
Matatandaang noong Marso 21 ng nakaraang taon, ibinasura ang reklamong libelo ni Gamilla sa Quezon City Prosecutor’s Office laban sa siyam na dating opisyal ng unyon dahil sa “lack of probable cause.” Inapila ito ni Gamilla sa Department of Justice.
Tumanggi rin si Gamilla na magbigay ng pahayag sa Varsitarian dahil na rin sa sub judice rule.
Noong Enero 2010, inakusahan ng Fidelity Group sina Gamilla at Garcia ng illegal disbursement sa property developer ng Saturn Resources, Inc., na naging dahilan ng pagrereklamo ng libelo ni Gamilla.
Samantala, naghain naman ng reklamo si Gamilla sa Quezon City Prosecutor’s Office laban kay Mario Villamor, pangulo ng Saturn Resources, Inc. noong Peb. 17, 2009.
